Who May Use
Hardin County Schools Performing Arts Center (PAC) shall be available to responsible and organized groups for purposes related to the performing arts that provide demonstrable benefit to the schools or to the community as a whole. Further, it is the intent of the Hardin County School Board (Board) to make the facilities as accessible as possible to the community while neither unduly interfering with instruction at John Hardin High School (JHHS) nor causing the district to assume excessive financial responsibility. The PAC will not be leased to for profit organizations for the sole purpose of making a profit.

Availability
The PAC Director shall determine when and which PAC facilities will be available and establish reasonable fees for their leasing. On recommendation of the PAC Director, the Board may grant a group or organization the use of facilities for an extended period.
Application and Contract
The conditions of usage of the PAC are governed by the Contract document. The Contract incorporates the Booking Information/Use Application as well as a Usage Guideline.

Liability
The Board shall require the leasing organization to assume all liability for injury to individuals by reason of the lease of Board property and that the organization indemnify and save harmless the Board from any loss or damage thereby.
Insurance
All use of the facility by non-Hardin County Schools organizations shall provide a certificate of liability insurance naming the Board as an additional insured under the policy for the activity.
Leasing Fees
The PAC Director must approve the use of facilities by all organizations and the appropriate leasing fee. A leasing fee based on the nature of the activity and the leasing organization and on minimum rates shall be assessed or the PAC Director shall negotiate a portion of the net profits for all use.
Exception
Activities that are sponsored by approved Hardin County Schools student organizations, employees’ groups, or school-related parent groups may use school facilities without being charged a fee when approved by the PAC Director and supervised by a PAC staff member at all times. No deposit is required for such usage but the organization involved will be held accountable for any and all damages incurred due to their usage. In addition, the need for a certificate of liability insurance is waived for all such activities.
Conditions of Leasing
Leasing of PAC facilities is subject to the following conditions:
- Leasing will be made only to responsible and organized groups, and responsible officers of that group must sign all necessary documents.
- Conditions of the Contract are set forth in the Booking Information/Use Application (Exhibit A) and Usage Guideline (Exhibit B). The conditions of leasing the facility are controlled by the Contract as well as the two exhibits which are incorporated into the Contract. The two exhibits are the Booking Information/Use Application (Exhibit A) and Usage Guideline (Exhibit B).
- Any and all additional provisions, permissions, conditions (such as copyright agreements and liability insurance) and agreements must be submitted at the time of contract signing along with the estimated payment in full unless other arrangements have been agreed to by both parties.
- Following the event, an invoice for any additional fees (unusual damages to facilities, additional services, supplies, etc.) will be presented for payment.
- Payment will only be refunded if the PAC receives written notification of the leasing organization’s cancellation no later than thirty days prior to that organization’s scheduled rental date. If cancellation occurs after that date, the PAC shall keep the payment to cover expenses incurred or lost due to the forfeiture of the leasing.
